Sharing, selling, or transferring membership benefits is strictly prohibited and may result in immediate termination without refund.Membership begins upon successful payment processing and confirmation. Memberships automatically renew at the then-current rate at the end of each billing period unless cancelled prior to renewal. Members are solely responsible for maintaining accurate and up-to-date payment information. Failed payments may result in suspension or termination of membership.Members may cancel at any time through their account or by contacting Boyer’s. Cancellation takes effect at the end of the current paid billing period. Boyer’s reserves the right to suspend, restrict, or terminate any membership at any time for non-payment, violation of these terms, misuse of benefits, fraudulent activity, or for any other reason, with or without notice, and without refund.All membership fees are non-refundable except as required by applicable law. Membership Billing

All members are enrolled in an auto-renewing annual billing plan. Membership fees are charged automatically each year using the payment method on file at the then-current rate.It is the member’s sole responsibility to keep payment information accurate and up to date. Boyer’s is not responsible for failed payments due to expired cards, insufficient funds, or outdated billing details.If a payment cannot be processed, Boyer’s may immediately suspend membership benefits until payment is successfully completed. Repeated or unresolved failed payments may result in termination of the membership without refund.Membership fees are non-refundable. No refunds, credits, or pro-rated amounts will be issued for partial years, unused benefits, cancellations, or early termination.Boyer’s reserves the right to change membership pricing at any time. Price changes will apply to the next renewal period. Continued membership after a price change constitutes acceptance of the new rate.Cancellation of membership does not entitle the member to any refund of fees already paid. Benefits remain available only through the end of the current paid annual term unless otherwise terminated by Boyer’s.By maintaining an active membership, the member authorizes Boyer’s to automatically charge the payment method on file for all renewal fees.

Cancellation

Members may cancel their membership at any time by contacting Boyer’s or through their account settings (if available).Annual memberships remain active and benefits continue until the end of the current prepaid membership term. Cancellation does not end benefits immediately and does not stop the current paid period.Membership fees already paid are non-refundable except where required by applicable law. No refunds, credits, or pro-rated amounts will be issued for early cancellation, partial terms, or unused benefits.Boyer’s reserves the right to cancel or terminate any membership at any time for non-payment, violation of terms, misuse of benefits, fraudulent activity, or for any other reason, with or without notice, and without refund.Once a membership is cancelled by the member, it will not auto-renew. Complimentary Small Engine Tune-Ups/ Services

If your membership includes complimentary tune-up services: Complimentary Service Terms & ConditionsComplimentary services are only available to active Boyer’s Repair Club members who are current on membership payments at the time the service is requested and performed.Complimentary services must be scheduled in advance and are subject to Boyer’s Repair scheduling availability.Complimentary services are non-transferable and may only be used by the enrolled member.Complimentary services have no cash value and cannot be exchanged, refunded, or redeemed for credit toward other services unless otherwise specified.Complimentary services are intended for routine preventative maintenance only. Additional repairs, replacement parts, troubleshooting, diagnosis, or services not specifically included in the membership benefits are not included and will require customer approval before work is performed.Equipment must be in reasonably serviceable condition to receive complimentary maintenance services. Equipment requiring excessive cleaning, disassembly, repair, or restoration before maintenance can be completed may be subject to additional charges with customer approval.Complimentary services apply to standard residential lawn and snow equipment only unless otherwise specified. Commercial equipment, fleet equipment, or specialty equipment may be excluded or subject to additional terms.Members are responsible for delivering equipment to Boyer’s Repair unless pickup and delivery benefits are included or otherwise arranged.Complimentary services must be used within the active membership term and do not roll over into future membership periods unless otherwise approved by Boyer’s Repair.Boyer’s Repair reserves the right to modify service procedures, included maintenance items, or membership benefits with reasonable notice to members.Complimentary Lawn Mower ServiceThe complimentary annual lawn mower service included with Boyer’s Repair Club includes the following maintenance items to 1 Push lawn mower, when applicable based on the equipment type and condition: If you have a riding mower or zero turn instead of a push mower there will be a $150 credit towards an annual service.The annual service includes:Engine oil change using the appropriate oil specification for the equipmentReplacement of spark plug(s)Inspection and replacement of air filter if neededBlade sharpeningChecking level and condition of all other fluids if equipped or applicableRemoval of built-up grass and debris from the mower deck and applicable areasFuel filter replacement if the equipment is equipped with a replaceable fuel filterLubrication/greasing of serviceable grease points when applicableGeneral inspection of the mower and basic operational checksCleaning/washing of the equipment after serviceThis complimentary service is intended as preventative maintenance to help keep equipment operating properly. Additional repairs, replacement parts, or services not specifically listed above are not included and will require customer approval before any additional work is performed.Complimentary Snowblower ServiceThe complimentary annual snowblower service included with Boyer’s Repair Club includes the following maintenance items to 1 Snowblower, when applicable based on the equipment type and condition:Engine oil change using the appropriate oil specification for the equipmentReplacement of spark plug(s)Inspection and replacement of air filter if the equipment is equipped with oneFuel filter replacement if the equipment is equipped with a replaceable fuel filterAdjustment of auger housing height/skid shoes as neededInspection of belts, auger system, drive components, and other major operating componentsGeneral inspection of the snowblower and basic operational checksCleaning/washing of the equipment after serviceOperational testing to help ensure proper function before returning the equipment to the customerThis complimentary service is intended as preventative maintenance to help keep equipment operating properly and ready for use. Additional repairs, replacement parts, or services not specifically listed above are not included and will require customer approval before any additional work is performed.

Question 6

Service Substitutions

If a member does not own or chooses not to use one of the included annual lawn mower or snowblower services, the member may request to substitute that unused service for routine maintenance on another eligible piece of outdoor power equipment.All substitutions are subject to prior approval by Boyer’s. Boyer’s reserves the sole discretion to determine whether a piece of equipment and requested service qualifies for substitution.A substituted service is intended to be reasonably comparable in labor, parts, and overall service value to the originally included service. If the requested substitute requires additional labor, parts, materials, or services beyond what Boyer’s considers comparable, the member will be responsible for the additional cost.Service substitutions apply to routine maintenance only and do not include repairs, diagnostics, replacement of damaged or failed components, or other additional work unless specifically approved by Boyer’s. Any additional repairs or services will be quoted and billed separately.Each included annual service may be used only once per membership year, whether used for the originally designated equipment or as an approved substitute. Substitutions do not create additional complimentary services.Unused services and substitutions have no cash value, cannot be redeemed for cash or account credit, cannot be carried over to a future membership year, and are non-transferable.

Question 7

Repair Discounts

Repair discounts apply only to qualifying repairs performed by Boyer’s while the membership is active and in good standing.Unless otherwise stated in writing by Boyer’s:•  Discounts apply to labor only.•  Parts, materials, and any third-party services are billed separately at normal retail pricing.•  Discounts do not apply to diagnostic fees, pickup/delivery fees, or other non-labor charges unless specifically stated.Boyer’s solely determines what constitutes a “qualifying repair” and reserves the right to deny a discount for any repair that does not meet its criteria.Discounts cannot be combined with other offers, promotions, coupons, or discounts unless approved in writing by Boyer’s.Discounts have no cash value, are non-transferable, and cannot be redeemed for cash or credit. Unused discount eligibility expires at the end of the membership term and does not roll over.Standard Boyer’s Repair Club members receive 15% off qualifying repair labor, up to a maximum of $300 in total repair labor discount savings per repair visit and up to $600 in total repair labor discount savings per 12-month membership term.Founding Members receive 20% off qualifying repair labor during their first 12-month membership term, up to a maximum of $300 in repair labor discount savings per repair visit, and up to $600 in total repair labor discount savings during the 12-month membership term. After the Founding Member’s first 12-month term, the standard 15% repair labor discount will apply to future membership terms unless otherwise stated by Boyer’s.Once a member reaches the $600 maximum repair labor discount savings during a membership term, additional repair labor will be billed at Boyer’s standard labor rate for the remainder of that membership term.Labor provided as part of an included or complimentary membership service is not eligible for an additional repair labor discount.Boyer’s reserves the right to modify, limit, or discontinue repair discount benefits for future membership terms. Any material changes to repair discount benefits will take effect upon the member’s next renewal unless otherwise required by law or necessary to prevent misuse or abuse of membership benefits.

Question 8

Pickup and Delivery

Reduced pickup and delivery pricing applies only within Boyer’s normal service area and only while the membership is active and in good standing.Additional travel charges, fees, or surcharges may apply for locations outside the standard service area. Boyer’s solely determines the boundaries of its normal service area and any applicable extra charges.Pickup and delivery scheduling is based on route availability, weather, staffing, and other operational factors. Boyer’s does not guarantee specific pickup or delivery dates or times.Boyer’s reserves the right to refuse, reschedule, or cancel any pickup or delivery request at its sole discretion. Membership does not guarantee priority over non-members for pickup and delivery services beyond what is expressly offered.Any reduced rates or benefits related to pickup and delivery have no cash value, are non-transferable, and cannot be exchanged for cash or credit. Unused benefits expire at the end of the membership term and do not roll over.Boyer’s is not responsible for delays, cancellations, or inability to provide pickup or delivery services due to circumstances beyond its control.

Question 9

Priority Scheduling

Members receive scheduling priority whenever reasonably possible while their membership is active and in good standing.Priority scheduling does not guarantee same-day, next-day, or any specific service date or time. Boyer’s does not promise or guarantee appointment availability.Emergency repairs, parts availability, seasonal demand, weather conditions, staffing levels, equipment issues, and other circumstances beyond Boyer’s control may affect or delay scheduling. Boyer’s reserves the right to prioritize work based on urgency, operational needs, and other factors at its sole discretion.Membership does not create any contractual right to preferred scheduling beyond what is reasonably offered. Boyer’s may modify or discontinue priority scheduling benefits at any time, with or without notice.Boyer’s is not liable for any delays, rescheduling, or inability to provide service on a requested date.

Question 10

Covered Equipment

Membership benefits apply only to eligible equipment approved by Boyer’s and serviced by Boyer’s.Eligible equipment may include, but is not limited to:Walk-behind lawn mowersRiding lawn mowersZero-turn mowersSnowblowersSmall engine equipmentOther equipment approved by Boyer’s at its sole discretionCoverage applies only to equipment that can reasonably be serviced by Boyer’s and is accepted into the membership program.The membership does not automatically cover every piece of equipment owned by the member. Equipment eligibility, service availability, and membership benefits are determined solely by Boyer’s.Commercial, rental, fleet, heavily modified, abused, neglected, or specialty equipment may be excluded from membership benefits or may require additional fees.Boyer’s reserves the right to refuse coverage or service for equipment that:Is unsafe to operate or repairHas excessive corrosion or damageHas been significantly modifiedHas been improperly repaired by othersRequires repairs beyond the scope of normal serviceCannot be reasonably serviced with available parts or equipmentCoverage is limited to equipment specifically approved under the membership. Boyer’s may update eligible equipment categories or coverage requirements at any time.

Repairs Not Included

Membership benefits do not include, unless specifically stated in the membership plan:Parts, fluids, consumables, or shop suppliesMajor engine repairs, rebuilds, or overhaulsEngine replacementTransmission, transaxle, or differential replacementElectrical system diagnosis or repairs beyond included servicesDiagnostic labor beyond services specifically included with the membershipRepairs resulting from accidents, collisions, misuse, abuse, neglect, improper maintenance, or unauthorized modificationsCosmetic repairs, paint, body, or appearance-related workTire, wheel, or structural frame repairsWarranty work covered by a manufacturer, dealer, or third-party warrantyRepairs requiring specialized outside vendors, machining, or subcontracted servicesPickup and delivery services unless specifically included in the member’s planEmergency, after-hours, or expedited service unless specifically offered by Boyer’sRepairs or services not specifically included under the membership will be billed at Boyer’s current labor rates and applicable parts pricing. Membership discounts, when applicable, apply only to qualifying repairs and services approved by Boyer’s.Boyer’s reserves the right to determine whether a repair or service qualifies for membership benefits and may decline work that falls outside the scope of the membership program.

Question 12

Additional Repair Authorization

Repairs or services not specifically included in the membership will not be performed without the customer’s prior authorization, except when necessary to protect the equipment, ensure safety, or comply with applicable law.Customers will be provided with an estimate for additional repairs whenever reasonably possible. Approval may be given in person, by telephone, text message, email, or other documented communication.All repairs, parts, labor, taxes, and applicable fees approved by the customer that are not covered under the membership are the sole responsibility of the customer and are due upon completion of the work unless otherwise agreed in writing.If additional repairs are declined, Boyer’s may return the equipment in its current condition, and the customer remains responsible for any approved charges or services already performed.Boyer’s is not responsible for mechanical failures or additional damage resulting from a customer’s decision to decline recommended repairs.

Question 13

Membership Abuse

Boyer’s reserves the right to suspend, revoke, or terminate any membership, with or without prior notice, if Boyer’s reasonably determines that the membership has been abused or used in a manner inconsistent with the intent of the program.Examples of membership abuse include, but are not limited to:Providing false or misleading informationFraudulent or deceptive claimsAttempting to transfer, share, or allow another person to use membership benefitsMisrepresenting ownership of equipmentRepeated misuse or excessive use of membership benefits beyond their intended purposeIntentional damage, neglect, or abuse of equipment to obtain covered servicesThreatening, abusive, harassing, or inappropriate behavior toward Boyer’s staffFailure to comply with these Terms & ConditionsAny activity Boyer’s reasonably determines is intended to exploit or misuse the membership programIf a membership is suspended or terminated due to abuse, misuse, fraud, or violation of these Terms & Conditions:All membership benefits immediately cease.No refunds, credits, or prorated reimbursements will be issued.The member remains responsible for payment of any outstanding invoices or previously authorized charges.Boyer’s reserves the sole right to interpret these Terms & Conditions and determine whether conduct constitutes abuse of the membership program.

Appointment Availability

Membership does not guarantee immediate, same-day, or next-day service. All appointments are scheduled based on Boyer’s normal business operations and are subject to availability.Scheduling may be affected by, including but not limited to:Seasonal demandTechnician availabilityShop workloadParts availabilityWeather conditionsEquipment complexityEmergency or priority repairsSupply chain delaysOther unforeseen circumstancesWhile Boyer’s may offer priority scheduling to members if included in the membership plan, priority scheduling does not guarantee immediate service or a specific appointment date or completion time.Estimated appointment dates and repair completion times are estimates only and are not guaranteed. Boyer’s is not responsible for delays caused by parts availability, weather, supplier delays, customer response time, or other circumstances beyond its reasonable control.Boyer’s reserves the right to reschedule appointments when necessary due to operational, staffing, safety, or unforeseen circumstances.Priority scheduling means members receive scheduling preference over non-members when reasonably possible, but it does not guarantee immediate service or precedence over emergency repairs, previously scheduled work, or situations outside Boyer’s control.

Parts Availability

Repair completion times are dependent upon the availability of parts and materials from manufacturers, distributors, and suppliers. Estimated delivery dates are provided for convenience only and are not guaranteed.Boyer’s is not responsible for delays caused by:Manufacturer or supplier backordersParts shortages or discontinued partsShipping or freight delaysSupply chain disruptionsIncorrect or damaged parts received from suppliersDelays caused by manufacturers, distributors, or third-party vendorsOther circumstances beyond Boyer’s reasonable controlIf required parts become unavailable, discontinued, or cannot be obtained within a reasonable period, Boyer’s reserves the right to cancel, postpone, or modify the repair. The customer will be responsible for payment of any approved labor, diagnostic time, or parts already installed or ordered on the customer’s behalf, including any non-returnable or special-order parts.Boyer’s will make reasonable efforts to keep customers informed of significant parts-related delays but cannot guarantee repair completion by a specific date.

Limitation of Liability

To the fullest extent permitted by applicable law, Boyer’s shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the membership program, services provided, or equipment serviced, including but not limited to:Loss of income or profitsLoss of business or business opportunitiesEquipment downtime or loss of useRental or replacement equipment costsMissed deadlines or scheduling delaysWeather-related lossesCrop, landscaping, or property lossesTowing, transportation, storage, or rental expensesDelays caused by manufacturers, suppliers, shipping carriers, or circumstances beyond Boyer’s reasonable controlBoyer’s is not responsible for failures or damage resulting from normal wear and tear, age, pre-existing conditions, improper operation, lack of maintenance, misuse, abuse, accidents, unauthorized repairs, or modifications performed by others.Except where prohibited by law, Boyer’s total liability for any claim arising out of or relating to the membership or services provided shall not exceed the amount paid by the member for the applicable membership during the current membership term.Nothing in these Terms & Conditions limits liability where such limitation is prohibited by applicable law.No WarrantyExcept as expressly stated in writing, the membership program does not create any express or implied warranty or guarantee regarding the condition, performance, reliability, or lifespan of any equipment. Routine maintenance reduces the likelihood of breakdowns but does not prevent normal wear, future failures, or unexpected mechanical problems.

Changes to Membership Benefits

Boyer’s reserves the right to modify, update, discontinue, or replace any aspect of the membership program at its sole discretion, including but not limited to:Membership pricingMembership benefits and servicesEligibility requirementsTerms & ConditionsDiscounts and promotional offersProgram policies and proceduresAny changes will apply prospectively and will not reduce benefits already purchased during a member’s current prepaid membership term unless required by law, necessary for safety, due to circumstances beyond Boyer’s reasonable control, or where a benefit becomes impossible to provide.Changes may apply upon renewal or to new memberships. Continued participation in the membership program after renewal constitutes acceptance of the then-current Terms & Conditions.Boyer’s will make reasonable efforts to notify members of material changes before they take effect.If any membership benefit becomes unavailable due to circumstances beyond Boyer’s reasonable control, Boyer’s may substitute a comparable benefit or discontinue that benefit without creating additional liability.

Question 18

Right to Refuse Service

Boyer’s reserves the right to refuse, suspend, or discontinue service or membership at its sole discretion when, including but not limited to, the following circumstances exist:Equipment is unsafe to inspect, repair, or operate.Repairs are not economically practical or exceed the value of the equipment.Required parts are unavailable, discontinued, or cannot be obtained within a reasonable time.The equipment has been significantly modified, neglected, abused, or previously repaired in a manner that prevents safe or reliable service.The requested repair cannot be reasonably completed with available tools, equipment, parts, or technical information.The customer provides false or misleading information regarding the equipment or requested repairs.The customer refuses to authorize necessary repairs required to safely perform the requested service.The customer engages in abusive, threatening, harassing, discriminatory, or unlawful conduct toward Boyer’s staff.The customer fails to comply with these Terms & Conditions or any applicable shop policies.Boyer’s may discontinue work at any time if continued service would be unsafe, unlawful, commercially unreasonable, or inconsistent with accepted repair practices.If service is refused after diagnostic work or authorized repairs have begun, the customer remains responsible for payment of all approved labor, diagnostics, parts ordered, parts installed, and any applicable fees incurred prior to the refusal of service.

Membership Expiration

Membership benefits are available only during an active membership term and expire immediately upon the expiration, cancellation, suspension, or termination of the membership.Unless otherwise stated in writing:Unused services, discounts, credits, or other membership benefits do not roll over to a future membership term.Unused benefits have no cash value and are non-refundable.Expired benefits cannot be redeemed, transferred, or reinstated after the membership has ended.Membership benefits apply only to services performed while the membership is active.Renewal of a membership does not restore or carry forward any unused benefits from a previous membership term unless expressly stated by Boyer’s.Boyer’s reserves the right to verify that a membership is active before providing any membership benefits.

Governing Law

These Terms & Conditions and the Boyer’s Repair Club membership program shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of law principles.Any dispute, claim, or legal proceeding arising out of or relating to the membership program, these Terms & Conditions, or services provided by Boyer’s shall be brought exclusively in a court of competent jurisdiction located within the State of Iowa, unless otherwise required by applicable law.If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
